We are Octant Travel, Inc. d.b.a. Octant Destinations ("Company," "We," "us," "our"), a company registered in Florida, United States at 370 Prof. Sims Street, Avon Park, FL 33825. We operate as a highly efficient, home-based office, allowing us to dedicate our focus to your custom journey.

Octant Destinations is a premier travel agency that offers a comprehensive range of personalized travel services. Our agency has over 30 cruise partners and numerous all-inclusive resorts. Our Wayfinders Travel consultants will help you navigate and set up a course to allow you to have a fun and seamless vacation. We specialize in Luxury, Bespoke, Disney, Universal, and Cruise vacation planning. Our team of experienced Travel experts provides a seamless and hassle-free Travel experience for our clients—from itinerary planning to accommodation, transportation, visa, and passport application—our experts take care of everything our clients need to create unforgettable Travel experiences that will be cherished for a lifetime. These legal terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity you, and Octant Travel Inc. d.b.a. Octant Destinations concerning your access to and use of the services. You agree that by accessing the services, you have read, understood, and agreed to be bound by all these legal terms. If you do not agree with all of these legal terms, then you are expressly prohibited from using the services, and you must discontinue use immediately.

Supplemental terms and conditions or documents that may be posted on the services from time to time are hereby expressly incorporated herein by reference. We reserve the right in our sole discretion to make changes or modifications to these legal terms from time to time. We will alert you about any changes by updating the last updated date of these legal terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these legal terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and have accepted, any changes in any revised legal terms by your continued use of services after the date of such revised legal terms are posted.

The services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the services. We recommend that you print a copy of these legal terms for your records.

1. OUR SERVICES

Agent for Suppliers and Payment Compliance

Octant Destinations acts as the sales agent for any airline, hotel, car rental company, tour operator, cruise line or other service provider named in our itinerary or confirmation suppliers. Octant Destinations acts as a Travel Consultant and is not responsible for the acts, errors, or omissions of the suppliers, Cruise Brothers (our host agency), or any other third-party provider, including their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits.

Octant Destinations operates as a hybrid travel agency, collaborating with various travel providers and serving as an independent affiliate agent in partnership with Cruise Brothers, a registered Seller of Travel. Octant Destinations and Cruise Brothers are separate business entities. Octant Destinations works with Cruise Brothers' preferred partners as well as other direct travel partners and suppliers not affiliated with Cruise Brothers. To ensure compliance with Florida travel regulations and the terms of our host agency affiliation, all payments for Octant Destinations' Professional Service Fees must currently be made directly to Cruise Brothers.

The process for payments is as follows:

Octant Destinations' Professional Service Fees (See Section 8): The Client acknowledges and agrees that all Professional Service Fees (e.g., Consultation, Planning, Management, Cancellation, Ticketing, etc.) will be processed through Cruise Brothers.
Trip Component Payments (Supplier Costs): Payments for the actual cost of the trip components (e.g., airfare, hotel bookings, cruise fare, tour operator costs) will be processed through Cruise Brothers OR directly to the specific travel supplier (e.g., a hotel, a non-affiliated tour operator, etc.), as directed by the Octant Destinations agent.
Check/Money Order Payments: If paying by check or money order, the instrument must be made payable to "Anywhere, Inc./Cruise Brothers" for fees, or payable to the specific supplier name for trip components, and forwarded to the address provided on the invoice.
Prohibited Payments: Octant Destinations will not accept payments directly from any Customer for fees or trip components in cash or via any cash or mobile application, including without limitation Venmo, Zelle, PayPal, Google Pay, Apple Pay, or similar apps until such a time that Octant Destinations can legally do so.

Future Payment Method Transition:

The Client acknowledges and agrees that Octant Destinations reserves the right to terminate its relationship with Cruise Brothers and begin accepting direct payments for its Professional Service Fees and/or Trip Components in the future. The Company will provide written notification to the Client of this transition via e-mail or on the Site. Upon such notification, the terms regarding the payment processor will automatically update to reflect Octant Destinations as the payment recipient.

Client Indemnification and Release of Liability

The Client agrees to indemnify and hold harmless Octant Destinations, Cruise Brothers, Anywhere Inc., and their respective agents, officers, and employees (collectively the "Indemnified Parties") from any and all claims, demands, losses, damages, or costs (including reasonable legal fees) arising out of or related to:

Any error, act, or omission on the part of the Client.
The failure of any third-party supplier to perform or adhere to their services, schedules, or contracts, including but not limited to bankruptcy or financial default.
Any claim brought by a third-party (including a supplier or another traveler) against the Indemnified Parties which arises from the services provided to the Client, except where such claim is the result of gross negligence or willful misconduct by Octant Destinations.

Limitation of Liability for Agency Errors

In the event that an error, omission, or oversight on the part of Octant Destinations or its agents causes a disruption to the client’s booked travel arrangements, the Client agrees that the total liability of Octant Destinations for any and all resulting financial loss, damage, or expense (including indirect, incidental, or consequential damages) shall be strictly limited to the aggregate amount of the professional service fees paid by the client to Octant Destinations for that specific trip.

Octant Destinations shall not be liable for any loss that could have been prevented or mitigated by the purchase of appropriate travel insurance.

2. EXCLUSIVE OFFERS & BOOKING POLICY

As a proud affiliate of Cruise Brothers and other preferred partners, Octant Destinations provides you with access to some of the industry's best deals and exclusive amenities.

To ensure you secure your preferred rate and inclusions, please note the following policy regarding all promotional offerings:

Booking Windows: All promotions have specific booking windows and capacity controls. You must confirm the dates and availability by contacting your Octant Destinations Travel Advisor before committing to a promotional offering.
Supplier Terms: All promotional offerings are subject to the expiration policy and the full terms and conditions stipulated by the cruise line or travel provider. Octant Destinations assumes no responsibility for determining the expiration date or the travel provider's promotional offerings.
Cruises: Port fees, government taxes, and other mandatory surcharges apply to all cruises and are in addition to the base advertised fare.
Hotels/Resorts: Mandatory resort fees, daily amenity fees, and deposits vary by property and apply to all hotel and resort stays. These fees are not always included in the initial quote and may be collected by the hotel upon check-in or check-out.

3. RISKS OF TRAVEL

We assume no responsibility for and shall not be liable for the acts or omissions of any particular party not under our control any acts or of God unsafe conditions, terrorism health hazards including pandemics illnesses, weather hazards or the suitability for a disabled person or of any portion of any trip we have no special knowledge of dangers during Travel or at destinations. For information related to such dangers, we recommend going to the Department of State Travel website at http://www.travel.state.gov. For medical and health information, we recommend going to the center of disease control website at http://www.cdc.gov/travel.

Health and Illness Liability Waiver: It is your personal decision that you travel and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of contracting infectious diseases, including but not limited to COVID-19, or any other illness or health hazard. You hereby expressly assume all of these risks and dangers and you hereby expressly agree to forever release, discharge, and hold us and our agents, employees, officers, our successors and assigns, directors, associates, affiliated companies, guides, group leaders, and subcontractors harmless against any and all liability, actions, causes of action, suits, claims, and demands of any and every kind of nature whatsoever which now you will have or which may hereafter arrive out of or in connection with these risks and dangers.

4. OUR INTELLECTUAL PROPERTY / 5. COPYRIGHT INFRINGEMENT

We are the owner of or the licensee of all intellectual property rights in our services including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the services (collectively, the "Content") as well as the trademark, service marks, and logos contained therein (the "Marks").

All Content and Marks are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws and treaties in the United States and around the world. The Content Marks are provided through in or through the services as is for your personal non-commercial use or internal business purpose only.

Your use of our services is subject to your compliance with these legal terms, including the Prohibited Activities section below. We grant you a nonexclusive, non-transferable, revocable license to access the services and download or print a copy of any portion of the Content which you have properly gained access solely for your personal, non-commercial use or internal business purpose except as set out in this section or elsewhere in our legal terms, no part of the services and no content or marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any purpose any commercial purpose whatsoever, without our express prior written permission.

If you wish to make any use of the services, content, or marks other than set as set out in this section or elsewhere in our legal terms, please address your request to: octantdestinations@outlook.com. If we ever grant you the permission to post, reproduce, or publicly display any part of our services or contact, you must identify us as the owners of licenses of the services, contents, or Marks and ensure any copyright or proprietary notice appears or is visible on posting, reproducing, or displaying our content.

We reserve all rights that are not explicitly granted to you in relation to the services, content, and trademarks. Any violation of these intellectual property rights will be considered a serious violation of our legal terms, and your right to use our services will be terminated immediately.

6. USER REPRESENTATIONS / 7. USER REGISTRATION

Accepted Forms of Payment

We accept the following forms of payment for transactions processed through our host agency, Cruise Brothers:

Checks or Money Orders (Made payable to Cruise Brothers/Anywhere, Inc. or the Supplier, as detailed in Section 1)
Visa
Mastercard
American Express
Discover

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the services. You further agree to currently update account and payment information, including e-mail address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us. All payments shall be in United States dollars.

If your order is subject to recurring charges, then you consent to our charging your payment method on a recurring basis for that requiring prior approval for each recurring charge until such time as you cancel the applicable order. We reserve the right to correct any errors or mistakes in pricing even if we already have requested or received payment. We may, at our sole discretion, limit or cancel quantities purchased per person, per household, or per order.

8. 💸 Professional Fees and Refund Policy

General Policy

All professional service fees paid to Octant Destinations are non-refundable and non-transferable. This policy compensates us for the time, expertise, and resources invested in designing and managing your custom itinerary, even if the trip is later canceled or postponed.

Any refunds for trip components (flights, hotels, tours, etc.) are solely subject to the specific terms and conditions of the respective service provider (airline, hotel, cruise line, etc.).

Octant Destinations Professional Fee Schedule

The following non-refundable professional service fees compensate Octant Destinations for specialized time, expertise, and management. All listed fees are processed exclusively through our host agency, Cruise Brothers (Anywhere, Inc.), as detailed in Section 1.

9. 🛡️ Travel Insurance and Liability Waiver

Travel Insurance is highly recommended for all travel arrangements.

Octant Destinations strongly recommends that every traveler purchase comprehensive travel insurance at the time of booking to protect against unforeseen circumstances, including but not limited to, trip cancellation/interruption, medical emergencies, emergency evacuation, baggage loss, and supplier default. Failure to purchase insurance may result in the forfeiture of non-refundable professional fees, trip costs, and any loss incurred due to cancellations or interruptions.

Octant Destinations’ Liability for Insured Losses:

The purchase of a travel insurance policy, whether secured through Octant Destinations or a third party, does not transfer financial liability for trip losses from the travel insurance provider to Octant Destinations. Octant Destinations is not an insurance company, and its role is limited to administration and advice. All claims, payments, and financial indemnification for covered losses are the sole and exclusive responsibility of the issuing travel insurance company, subject to the terms of their specific policy.

Client's Choice Regarding Insurance:

The Client must select one of the following options regarding Travel Insurance:

Purchase via Octant Destinations: Leave both boxes unchecked. The applicable Travel Insurance Management Fee will be added to the invoice (See Section 8).
Using Own/Third-Party Policy: Check the box below if you are using an existing or third-party travel insurance policy (e.g., a corporate or annual credit card policy).
Waive/Decline All Coverage: Check the second box below if you decline all travel insurance coverage.

☐ I confirm that I am securing an external, third-party travel insurance policy which provides equivalent coverage for this trip. I understand that I am solely responsible for providing proof of this coverage to Octant Destinations upon request. If I fail to provide proof of a valid third-party policy upon request, Octant Destinations shall assume I have waived all coverage and Octant Destinations is not responsible for any loss or financial consequence arising from the lack of insurance.

Waiver of Travel Insurance (Decline All Coverage)

☐ I have been offered and hereby decline the purchase of travel insurance for my trip, and I do not have an existing policy. I accept full financial responsibility for any related losses, costs, or expenses that may occur and waive any claim against Octant Destinations related to this decision.

10. PROHIBITED ACTIVITIES

You may not access or use the services for any purpose other than that for which we can make the services available. The services may not be used in connection with any commercial endeavors except those that are expressly endorsed or approved by us. As a user of the services, you agree not to:

Systematically retrieve data or other content from the services to create, compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
Circumvent, disable, or otherwise interfere with security-related features of the services.
Disparage, tarnish, or otherwise harm, in our opinion, Us and/ or the services.
Upload or transmit viruses, Trojan horses, or other material, including excessive use of capital letters and spamming, that interferes with any party's use and enjoyment of the services.
Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
Attempt to impersonate another user or person or use the username of another user.
Upload or transmit any material that acts as a passive or active information collection or transmission mechanism (e.g., GIFs, web bugs, cookies, or similar spyware/PCMs).
Interfere with, disrupt, or create an undue burden on the services or the networks connected to the services.
Attempt to bypass any measures of the services designed to prevent or restrict access.
Copy or adapt the services software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
Except as permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the services.
Use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, utility, scraper, or offline reader that accesses the services, except as may be the result of standard search engine or Internet browser usage.
Use a buying agent or purchasing agent to make purchases on the Services, except when you contact and use Octant Destinations as your buying agent.
Make any unauthorized use of the Services, including collecting usernames and/or e-mail addresses for unsolicited e-mail, or creating user accounts by automated means or under false pretenses.
Use the surfaces as part of any effort to compete with us or otherwise use the services and/ or the content for any revenue-generating endeavor or commercial enterprise.
Illegal activity: engaging in any activity that violates federal, state, Florida, or local laws (e.g., illegal gambling, drug sales, or copyright infringement).
Data misuse: collecting, storing, or using personal information of others without their consent, or in violation of privacy laws.
Use the Services to advertise or offer to sell goods and services, unless you are granted express permission by Octant Travel, Inc. d.b.a. Octant Destinations. For more information contact: octantdestinations@outlook.com.
Hate speech and discrimination: promoting or inciting violence or discrimination based on race, religion, gender, sexual orientation, or any other protected characteristic.

11. USER GENERATED CONTRIBUTIONS

The services may invite you to chat, contribute to, or participate in blogs, message boards, online forums, and other functionality. When you create or make available any content and materials (collectively "Contributions"), you thereby represent and warrant that:

The creation, distribution, transmission, public display, or performance of your contributions do not and will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark, trade secret, or moral rights of any third party.
You are the creator and owner or have the necessary licenses, rights, consent, releases, and permissions to use and to authorize the services and other users to use your contributions.
You have the written consent, release, and/or permission of each and every identifiable individual person in your contributions to use their name or likeness.
Your contributions are not false, inaccurate, or misleading, nor are they unsolicited or unauthorized advertising.
Your contributions are not obscene, lewd, severe, filthy, violent, harassing, libelous, slanderous, or otherwise objectionable as determined by us.
Your contributions do not violate any applicable law, regulation, or rule, nor do they violate the privacy or publicity rights of any third party.

Any use of the services in violation of the foregoing violates these legal terms and may result in the termination or suspension of your right to use the services.

12. CONTRIBUTION LICENSE

By posting your contributions, you automatically grant, and you represent and warrant that you have the right to grant, to us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right, and license to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute such contributions (including without limitation your image and voice) for any purpose, commercial, advertising or otherwise, and to prepare derivative works of or incorporate into other works such contributions.

We do not assert any ownership over your contributions. You retain full ownership of all your contributions and any intellectual property rights. You are solely responsible for your contributions, and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your contributions. We have the right, in our sole discretion, to edit, redact, recategorize, copy, screen, or delete any contributions at any time without notice. We are not obligated to monitor your contributions.

13. GUIDELINES FOR REVIEWS

We may provide you with areas on the services to leave reviews or ratings. When posting a review, you must comply with the following criteria:

You should have first-hand experience with the person or entity being reviewed.
Your review should not contain offensive profanity, abusive, racist, offensive, or hateful language.
Your review should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability.
Your review should not contain references to illegal activity.
You should not be affiliated with the competitors.
You should not make any conclusions regarding the legal consequences of a situation without proper legal advice.
You may not post any false or misleading statements, and you may not organize a campaign encouraging others to post reviews.

We reserve the right to accept, reject, or delete any reviews at our sole discretion. We are not obligated to screen or remove any reviews, even if they are deemed offensive or inaccurate by anyone. Reviews are not endorsed by us, nor do they necessarily reflect our opinions or the views of our affiliates or partners. We do not assume any responsibility for reviews or for any claims, liabilities, or losses that may arise from them. By posting a review, you are granting us a perpetual license to use it.

14. ACKNOWLEDGMENT AND AGREEMENT

By proceeding with a booking, submitting a payment, or clicking the "I Agree" button or checkbox on our website or booking portal, the Client acknowledges that they have read, understand, and agree to all the Terms and Conditions set forth in this document, including specifically the Health and Illness Liability Waiver (Section 3), the Professional Fees and Refund Policy (Section 8), the Waiver of Travel Insurance (Section 9), the Limitation of Liability for Agency Errors (Section 1), and the Client Indemnification and Release of Liability (Section 1).
